dr. sober companion is trying to sort out the death of 36 year old, adam michael goldstein aka DJ AM, and I am in disbelief, because know matter how many obstacles in life that was blocking adam michael goldstein aka DJ AM, he got through it, with astonishing success.

Because this is a sober companion blog, and we work on 100% abstinence of drugs and alcohol, and a complete removal of all enablers, we must ask the questions:

Was this a drug overdose at the hands of an over prescribing dr. feelgood medical prescription?

Was this suicide by drug overdose?
We know one thing, thanks to TMZ, prescription pill vials were at the scene of the death. If this was drug related, than dr. sober companion could have saved the life of another young person. Thats a fact!



1. the fat years of DJ AM
DJ AM underwent Gastric Bypass Surgery, which made him thin. While a fat person who instantly becomes thin, can have severe psychological problems, he appeared to overcome that obstacle in life. Although he still ate like a fat person, purchasing oreo cookies, frosted flakes, regular coca cola, cheese wiz, on a trip to a local grocery store. DJ AM was once quoted as saying: “I have to remind myself that I'm a fat crackhead who’s lucky to be alive.”

2. the drug addict alcoholic DJ AM
DJ AM was once quoted about kicking his drug addiction and alcoholism: “I no longer needed a trophy girlfriend or drugs to feel good about myself. It’s been nine and a half years since I’ve had a drink or taken drugs. But every day I have to remind myself that no matter how much time I have behind me, I’m still a drug addict. At any given moment, I’m five seconds away from walking up to someone, grabbing their drink out of their hand and downing it. And if I do that, within a week, tops, I’ll be smoking crack.” DJ AM sounds like a member of AA or NA, in that he still classifies himself as a drug addict, even though he is recovering. dr. sober companion wants to remind the parents of drug addicts and alcoholics seeking help in drug and alcohol rehab, that once someone is a drug addict or alcoholic, they remain one, and that is why it is dangerous to leave your children with a drug addict or alcoholic in a drug rehab facility, no matter how expensive it may be. Sources tell TMZ prescription pill bottles were found near DJ AM's body this afternoon. A law enforcement source on scene tells TMZ a glass "crack pipe" was found in his bedroom. The pill bottles were found in the kitchen.

DJ AM was once quoted about his girlfriends: “I no longer needed a trophy girlfriend or drugs to feel good about myself. " appearently, yes you did need something other than drugs to feel good about yourself. Breaking up is very hard and leads to depression.


4. the private jet crash of DJ AM
DJ AM had luck: “Anybody who can survive a plane crash is very lucky.” Thats why dr. sober companion felt, if you have a man that is this lucky, to cheat death, that he could accomplish anything in life. Unfortunately, guilt is very strong, and the death of 4 people on the same flight, may have been to much to handle. Parents can enable their children and unknowingly push their children to near death drug overdoses with their own brand of guilt. Sometimes you need to hire dr. sober companion to remove the enablers, and poisonous people from your childrens lives, including yourselves. (but not permanently)

We're also told DJ AM was having a very hard time dealing with post-traumatic stress from the plane crash he survived in September of last year.

DJ AM was once quoted about his past suicide attempt: “at 24 I felt like my life was over. I went into my living room, reached into a cabinet above my TV and grabbed my gun, a loaded .22. I sat back on my heels, cocked it and put it into my mouth. I pulled the trigger. The gun didn’t go off. I thought, ‘Are you kidding me? I’m such a fucking failure I can’t even kill myself? I dropped the gun and broke down. That was the turning point in my life.” How many chances in life do people have to cheat death? If you see a destructive pattern is growing, you must take drastic steps as a parent to intercede. Some details:

Adam Goldstein — was found dead this afternoon in New York City.Law enforcement sources tell tmz he was found in his apartment at around 5:20 PM.

DJ AM had not been seen or heard from for a few days. One of his friends went to check on him, but got no response after knocking on his apartment door.

The friend called the police, who broke down the door and then found DJ AM’s body.

Sources said drug paraphernalia was found in the apartment. He was 36 years old.



DJ AM was a major attraction and was worth the wait of getting into wherever he was spinning. DJ AM had a unique mix of hip-hop, rock and ‘80s hits that made for a great time on the usually crowded dance floor. Even though DJ AM was not there nightly, LAX usually has a celeb or at least A-List DJ ranging from Steve Aoki to Benji Madden from Good Charlotte or Adam 12 of She Wants Revenge.

DJ AM was sought after around the entire world, and had opened a second club LAX at the luxor in las vegas. club LAX in vegas is known as the hottest club to land in Sin City, LAX Nightclub, continues to rock The Strip with unrivaled parties.

DJ AM dated socialite and reality TV star Nicole Richie and also singer/actress Mandy Moore. DJ AM also was linked to Canadian supermodel Jessica Stam. Basically, DJ AM was a bonafide pimp.

DJ AM was also a former member of the rock band, Crazy Town, known for their hit, “Butterfly”. DJ AM has also scratched on albums for Papa Roach, Madonna, Will Smith and Shifty. DJ AM has played private events for celebs like Jim Carrey, Jessica Simpson, Jennifer Lopez, Ben Stiller, Leonardo DiCaprio, Ashton Kutcher, Demi Moore, Kate Hudson. DJ AM had recently collaborated with Travis Barker of blink-182 and +44 in several performances.

DJ AM is also an avid ’sneakerhead’ and collects a variety of athletic shoes, the majority of which are by nike. His collection of over 600 shoes, includes a pair of Nike Air Force 1 shoes that were created specifically for him, with his DJ AM logo appearing on the shoe itself.

Gastric bypass surgery:

First of all, if you didn’t know, DJ AM wasn’t always a skinny guy. Before he dated Nicole Ritchie, he was a fat guy, that underwent Gastric Bypass Surgery. I found this study online which documents my suspicions regarding high suicide rates of patients of gastric bypass/stomach stapling surgery.

October 29, 2007 — Extremely obese Pennsylvania residents undergoing weight loss surgery over a 10-year period had a higher-than-expected mortality rate from suicide, according to a new study appearing in the October issue of Archives of Surgery. The study also uncovered an excess of deaths due to coronary heart disease among these surgery patients.

The large number of deaths from suicides and drug overdoses is “a cause for concern,” the authors, led by Bennet I. Omalu, MD, from the University of Pittsburgh, in Pennsylvania, write. The fact that most of these deaths occurred at least 1 year after surgery suggests that “careful follow-up, especially the need to recognize and treat depression, should be provided for patients who have undergone bariatric (gastric bypass) surgery,” they write.



The private jet crash:

The plane that crashed, killing 4, is owned by Global Exec Aviation, a Long Beach-based charter company, and was certified to operate last year, an NTSB official said.

DJ AM, whose real name is Adam Goldstein, has been released from the hospital after suffering injuries from a plane crash that killed four people last week, his rep confirmed to Access Hollywood.

“Adam Goldstein has been released from Doctors hospital,” the rep said in a statement. “While he is deeply saddened by the events he is thankful for all of the love and support he has been receiving from fans and friends world wide. We ask that you continue respect his privacy as he rests and heals and mourns the loss of his friends”.

Adam arrived back home on Thursday – by bus.

“That might tell you something about his desire to use or not use airplanes in the future,” Perez said.
But while DJ AM has returned, fellow passenger and TRVSDJ-AM musical collaborator, Travis Barker remains in the hospital.
“[Adam] just said to me to pray for Travis, so that makes me a little concerned that Travis’ injuries might be more severe than his were,” Perez said.

One of the first responders to the crash has said that Barker and DJ AM escaped the flaming wreckage by sliding down the jet’s wing.

“They said the plane went down. They didn’t say how or if they knew,” Lt. Jason Shumpert of the South Congaree Police Department told the Associated Press. “Once it went down, they were able to slide down the wing of the plane, and they jumped on each other to put fires on each other out and rolled around on the ground.”

Shumpert said he didn’t know until later that the two badly burned men were former Blink-182 drummer Travis Barker and celebrity disc jockey DJ AM, whose real name is Adam Goldstein. One of their doctors at a Georgia burn hospital said he expects them to fully recover from their second- and third-degree burns.

A video of the Friday night crash scene shot from Shumpert’s police car shows an inferno next to the road, with screams ringing out above the din of sirens of ambulances and fire trucks. Shumpert said the screaming voice belonged to Barker, who was trembling and seemed to be in intense pain as he sat on the sidewalk, waiting for medical help to arrive.

“Travis, you could tell he was in pain,” Shumpert said. “He just kept saying: ‘That’s my friends in the plane, that’s my friends in the plane.’”

Officials with the National Transportation Safety Board have not said what caused the crash. A cockpit voice recorder revealed that crew members thought a tire blew and tried to abort the takeoff. The Learjet shot off the end of the runway, ripped through a fence and crossed a highway before coming to rest, engulfed in flames.

NTSB officials, who have recovered pieces of tire from the runway, planned to return to Washington on Thursday. Goodyear Tire & Rubber Co., which made the tires, has said it is cooperating with the investigation.

“It was divine intervention that they got out,” he said. “They should be commended for being able to get out and keep their heads together.”

“Since both Barker and Goldstein are in overall good health and didn’t suffer from any other crash-related complications, a full recovery is expected,” said Dr. Fred Mullins of the Joseph M. Still Burn Center at Doctors’ Hospital in Augusta at a Sunday morning press conference.

Mullins added that recovery from such burns can take as long as a year.

A few months later he launched a lawsuit against the insurance companies that insured the pilots.

TMZ has just obtained documents from the suit DJ AM filed, and he's asking for $20 million dollars... minimum.

DJ AM wants at least $10 million in damages for medical bills, lost earnings and profits and other economic damages, and another $10 million for mental and physical pain he suffered and other "non-economic losses."

Everyone is familiar with cover ups to protect the family, and to what extent family loyalty plays in the death of Michael Jackson. Do the Jackson family think they can get away with evidence tampering, then after everything is removed, to return and plant new evidence not discovered by police dogs trained in detecting drugs, and police investigators and detectives?

The reason you are reading about the michael jackson death on a sober companion blog, is that I want you to know that michael jackson would still be alive if dr. sober companion was hired.

I know this to be a fact, because dr. sober companion works by total abstinence of drugs and alcohol and complete removal of enablers, including family and especially doctors hired to administer injections.

This proves that Dr. Murray and the jackson family are working together on a scheme that is not completely apparent at present time. It was a done deal that dr. murray would lose his medical license, and serve time, but is it strong enough to put the blame on him and deflect blame on michael jackson and his enabling family?

Well we know that this damage control method is working, because everything bad about michael jackson in truth and rumors has melted away. Charges of child molestation and secret rooms filled with nazi memorabillia, songs of anti semitism are almost completeley forgotten
and erased, now that michael jackson has been compared to a saint. Record sales are through the roof, and video game rockstar is going to release the beatles on 9/09/09 which michael jackson's estate owns most of the publishing rights to the songs used in the video game.



Crime scene / do not enter

The smoking gun is EVIDENCE TAMPERING, and it happened before our eyes.

After watching TV shows like COPS, CSI, LAW AND ORDER and even DRAGNET and the general knowledge of when the police put up a police line with yellow tape that says crime scene, do not enter / do not cross, its because of an investigation for evidence.

Is this not clear that the yellow tape is outside the crime scene?


Is this not proof, that nothing leaves or comes in the crime scene?

Maybe the police or the district attorney can then explain the following:


A moving van was seen leaving the home of Michael Jackson this afternoon after, we're told, his father Joe Jackson ordered Michael's belongings removed from the home and put in a storage facility.

Search warrants were issued to search Michael Jackson's house ... the searches have already taken place.

The searches that took place yesterday and last Friday were performed as a result of the warrants.

Michael Jackson's Mom Fears Looting

The lawyer for Michael Jackson's mother filed documents in court today, sounding the alarm that people up to no good will try and fleece Michael's estate. The court had apparently had enough concern to make Katherine the administrator of the estate pending a hearing next Monday.

Katherine's attorney, Burt Levitch, claims there are numerous bank accounts of Michael's that are being controlled by third parties. He says the bank accounts are used "to pay expenses of [Michael's] parents' home." Levitch says these bank accounts need to be controlled so third parties don't misspend the money.

Levitch also says there is worry about Michael's stake in the Sony-ATV Music Publishing Catalog -- which includes Beatles' works -- that Levitch says is the most important asset in the estate. Levitch says no one is now representing Michael's interests and he wants Katherine to step in her late son's shoes.

Levitch says at least one person is claiming to have a power of attorney to act on Michael's behalf. Although a power of attorney would have ended when Michael died, Levitch worries that not everyone knows that and assets could be misappropriated.



Katherine has the right under the order "to control tangible personal property currently in the physical possession of a third party, and to marshall and secure such assets."

You know what the breaking news of the morning is? A friggin moving van in front of Michael Jackson's house. And it wasn’t just a quick one-liner deal either. Hell, you woulda thought Kim Jong-il lobbed a nuke at Hawaii (it’s a damned good thing your vacation is over Buffy) or something. OK, I go into the kitchen, make coffee, come back and the damned moving van is still on the tube.

The Associated Press reports Jackson arrived to Michael Jackson's Holmby Hills residence wearing dark glasses and went straight into the property, where outside two moving trucks were parked and had arrived shortly before.

About eight movers were seen entering the property with dollies and packing equipment, says the AP.

It us not immediately clear who sent the movers or what items they could be taking out of the residence.

Two moving vans arrived at Michael Jackson’s rented Holmby Hills mansion this morning, and workers are removing items from the home and loading them into one of the vans.

The large, white Atlas Van Lines trucks came about the same time Janet Jackson arrived. She drove up in a maroon Bentley while wearing dark sunglasses. Before noon, one truck was inside the estate’s massive black gates, and the other van waited outside.


Meanwhile, hundreds of fans continued to converge at Grauman’s Chinese Theatre on Hollywood Boulevard, lining up to catch a glimpse of Michael Jackson’s star on the Walk of Fame, with almost everyone carrying a snapshot camera or cellphone camera. Security guards hurried fans along, with one telling them, “Hurry up and take a picture!” A few fans placed roses, signs, teddy bears, balloons and photos near the star; the items stretched for several feet along the sidewalk.

On top of Jackson’s star lay a rosary and five red roses. A cluster of candles was placed just off to the side.

At the Jackson family home in Encino, dozens of fans joined dozens of photographers and journalists waiting for any movement inside the home.

As they stood outside in the blazing sun, some emotional fans sought comfort in posting pictures and notes on the wall outside the home. Others surveyed the journalists as they walked up to the wall, hoping to get interviewed or photographed.



Before noon, several boxes of Domino’s pizza arrived at the home, and a few were given to police officers standing watch. Two black minivans left the home this morning. Later, a UPS driver delivered a package.

Unidentified personnel stand by a moving van outside the home rented by Michael Jackson in the Holmby Hills section of Los Angeles Saturday. Janet Jackson arrived at the Holmby Hills estate Saturday, where moving vans arrived earlier in the day.

Two days after Jackson died at a Los Angeles hospital, sisters Janet and La Toya arrived at the mansion Jackson had been renting. They left without addressing reporters.


Moving vans also showed up at the Jackson home, leaving about an hour later. There was no indication what they might have taken away.

The Jackson family issued a statement Saturday expressing its grief over the death and thanking his supporters.

"In one of the darkest moments of our lives we find it hard to find the words appropriate to this sudden tragedy we all had to encounter," said the statement made through People magazine. "We miss Michael endlessly."


Police towed Murray's car from Jackson's home hours after Jackson died and said later it could contain medication or other evidence. Coroner's officials also said Jackson was taking prescription medication but declined to elaborate.

Of course, there was far more unease in what the exhibition revealed about Jackson's megalomania and arrested development. MOVING VANS EMPTY HOME

The celebrity website TMZ.com reported that a second autopsy was underway at an undisclosed location in Los Angeles on Saturday afternoon, on the orders of the Jackson family.

Speculation has centered on Jackson's use of prescription drugs and reports that he was injected with the narcotic painkiller Demerol shortly before he went into cardiac arrest.

Coroner's officials have said that with no outward signs of trauma to Jackson's body or evidence of foul play, they would have to wait for the results of toxicology tests and other studies to establish a cause of death.

Few other details were released about the autopsy's findings, but Fox News reported on its website that investigators had found his body to be healthier and stronger than they had expected, with some scarring on the face.

Moving van crews emptied the rental home of Jackson's belongings, reportedly on the orders of his father, Joseph, who was concerned they would be stolen.

Nurse Jackie Peyton is a drug addicted hospital nurse. I always wondered how emergency room hospital staff could pull off double and triple shifts. RN's, MD's, and Interns get the pep from prescription pills. Is this that far from the truth, or just a TV show?

How far and how long have the jackson family hid michael jackson drug addiction?

Stressful situations make a drug addict turn towards drugs as a way to deal and cope with their situation. Sometimes the situation turns towards suicide. Could the family have stopped the suicide? Is it suicide if the drugs are supplied to the victim?

‘Randy said Michael had been under severe stress because of the television program which had aired that night.

‘I recall him saying that an earlier TV documentary had caused all manner of problems and that Michael had worked himself into a frenzy of anxiety over this one.’

Randy followed up the prison term with a trip to a psychatric facility for 1 month. He had 1 more children Randy Jr. with the lady he cheated with during his first marriage.

Ok, now that we cleared things up on why an enabling brother was giving advice to Michael Jackson, and trying to say he offered help, advice and tried to get Michael committed just as he was. In the end, you can say this was a failure as not even the most trusted and loved family member (besides Michaels mother) could help him.

DENIAL

Because of denial, most addicts refuse rehab so that is why a sober companion is of most importance. Its like going to rehab, because you get many of the same benefits, without learning from other addicts on how to become a greater addict.

Another difference of opinion is that Dr. Samuels tries to get the celebrity to feel less important, when he said: "Really getting the individual to have an understanding that it's not about them, that they are not the center of the universe. It's not about "don't you know who I am?"
Why do addicts try different rehab centers besides wonderland?

While Dr. Sober companion feels that an addict can learn very destructive techniques from fellow addicts in the setting of rehab centers, they might not to return for their willingness to become sober, but instead gain new suppliers, learn about new drugs, best pill pushing doctors, and other unsaviory techniques of denial.

Is replacemt therapy the immedate cure?

The main ingredient that some rehab centers and sober companions that work with the rehab centers use for an immediate cure for a drug and alcohol addict is to feed them another prescription to replace the original addiction. this is known as the replacement therapy

The bombshell that NBC Today show missed, was that dr. sober companion was hired to be the sober companion for Michael Jackson London tour

Because dr. sober companion respects the request for privacy for his clients, he would not confirm or deny the report to NBC today show reporters, when he was interviewed.

NBC Today show missed the boat with their segment with Dr. Rob Tencer, by instead following a drug addict as he went undercover to a medical doctors office, and deleted all but one sentence of Dr. Rob Tencer's interview. "They told me they had their agenda, and that the work of a sober companion was unimportant to them. They only wanted to know about drug use of celebrities." said Dr. Rob Tencer of dr. sober companion.

Michael Jackson agreed to hire a sober companion before his death, to accompany him on his London tour, reported health care examiner Sheila Guilloton of the examiner on July 20, 2009.

While the examiner mentioned rehab and other forms of replacement therapies, it seemed to veer away from the usefulness of a sober companion.

After the parties settled that suit for an undisclosed sum, respondent’s physician sent her a letter in which he admitted “responsibility” for her injury and expressed his “profoun[d] regre[t]” and “remors[e]” for his actions. 1 Tr. 178–179 (Mar. 8, 2004) (testimonyof Dr. John Matthew); see also App. 102–103 (testimony of physician’sassistant Jessica Fisch) (noting that her “sense of grief” was so “great” that she “would have gladly cut off [her own] arm” and given it torespondent). Thereafter, both the physician and the physician’s assistant agreed to testify on respondent’s behalf in her suit against Wyeth.

The significance of the supreme court ruling is that the blame game can now include pharmaceutical companies and not just the doctors who administered the drugs. I think the only reason people never thought of this before was that pharmaceutical companies were largely untouchables.

Wyeth (a pharmaceutical company), filed a motion for summary judgment, arguing that Levine’s failure-to-warn claims were pre-empted by federal law.

Just because a drug is FDA approved, and has a federal law approved warning label, this does not mean the drug won't kill you.

If a drug kills enough people, it is taken off the market, however if it is because of overdose, it is blamed on the person taking it. If a drug causes distinct negative side effects, those are added to the micro sized small print. Is this adequate to save lives? Dr. sober companion says this is not adequate to save lives.

The following is exerted from Wyeth v. Levine

Petitioner Wyeth manufactures the antinausea drug Phenergan. After a clinician injected respondent Levine with Phenergan by the “IV-push” method, whereby a drug is injected directly into a patient’s vein, the drug entered Levine’s artery, she developed gangrene, and doctors amputated her forearm. Levine brought a state-law damages action, alleging, inter alia, that Wyeth had failed to provide an ade-quate warning about the significant risks of administering Phener-gan by the IV-push method. The Vermont jury determined that Le-vine’s injury would not have occurred if Phenergan’s label includedan adequate warning, and it awarded damages for her pain and suf-fering, substantial medical expenses, and loss of her livelihood as aprofessional musician. Declining to overturn the verdict, the trial court rejected Wyeth’s argument that Levine’s failure-to-warn claimswere pre-empted by federal law because Phenergan’s labeling hadbeen approved by the federal Food and Drug Administration (FDA). The Vermont Supreme Court affirmed.

Wyeth’s argument that requiring it to comply with a state-law duty to provide a stronger warning would interfere with Congress’ purpose of entrusting an expert agency with drug labeling decisions is meritless because it relies on an untenable interpretation of con-gressional intent and an overbroad view of an agency’s power to pre-empt state law. The history of the FDCA shows that Congress didnot intend to pre-empt state-law failure-to-warn actions. In advanc-ing the argument that the FDA must be presumed to have estab-lished a specific labeling standard that leaves no room for different state-law judgments, Wyeth relies not on any statement by Congress but on the preamble to a 2006 FDA regulation declaring that state-law failure-to-warn claims threaten the FDA’s statutorily prescribed role.

The warnings on Phenergan’s label had been deemed sufficient by the federal Food and Drug Administration (FDA) when it approved Wyeth’s new drug application in 1955 and when it later approved changes inthe drug’s labeling. The question we must decide is whether the FDA’s approvals provide Wyeth with a com-plete defense to Levine’s tort claims. We conclude that they do not.

I don't know if you understand the significance of this supreme court ruling, so let me try to explain in more detail.

Wyeth lawyers made it clear the blame game has changed when it argued that recognition of Levine’s state tort action creates an unacceptable “obstacle to the accomplishment and execution of the full purposes and objectives of Congress,” Hines v. Davidowitz, 312 U. S. 52, 67 (1941), because it substitutes a lay jury’s decision about drug labeling for the expert judgment of the FDA.

Do you now begin to see the layers of government protection that was afforded the pharmaceutical companies? Do you begin to see lobbying efforts, and the billions of dollars that went into paying off congress for their votes. The government protection afforded them is now unravelling before our eyes.

Indeed, prior to 2007, the FDA lacked the authority toorder manufacturers to revise their labels. See 121 Stat. 924–926. When Congress granted the FDA this authority,it reaffirmed the manufacturer’s obligations and referred specifically to the CBE regulation, which both reflects the manufacturer’s ultimate responsibility for its label and provides a mechanism for adding safety information to the label prior to FDA approval. See id., at 925–926 (stating that a manufacturer retains the responsibility “to main-tain its label in accordance with existing requirements, including subpart B of part 201 and sections 314.70 and
601.12 of title 21, Code of Federal Regulations


We also learn from this case that the pharmaceutical companies try to blame the doctor as noted here: Nevertheless, the jury rejected Wyeth’s argument that the clinician’s conduct was an intervening cause that absolved it of liability. See App.234 (jury verdict), 252–254. In finding Wyeth negligent as well as strictly liable,

federal law and FDA labeling

In order to identify the “purpose of Congress,” it is ap-propriate to briefly review the history of federal regulation of drugs and drug labeling. In 1906, Congress enacted itsfirst significant public health law, the Federal Food andDrugs Act, ch. 3915, 34 Stat. 768. The Act, which prohib-ited the manufacture or interstate shipment of adulter-ated or misbranded drugs, supplemented the protection for consumers already provided by state regulation and common-law liability. In the 1930’s, Congress becameincreasingly concerned about unsafe drugs and fraudulent marketing, and it enacted the Federal Food, Drug, and Cosmetic Act (FDCA), ch. 675, 52 Stat. 1040, as amended,21 U. S. C. §301 et seq. The Act’s most substantial innova-tion was its provision for premarket approval of new drugs. It required every manufacturer to submit a newdrug application, including reports of investigations and specimens of proposed labeling, to the FDA for review.Until its application became effective, a manufacturer was prohibited from distributing a drug. The FDA could reject an application if it determined that the drug was not safe for use as labeled, though if the agency failed to act, anapplication became effective 60 days after the filing. FDCA, §505(c), 52 Stat. 1052.
In 1962, Congress amended the FDCA and shifted the burden of proof from the FDA to the manufacturer. Before 1962, the agency had to prove harm to keep a drug out of the market, but the amendments required the manufac-turer to demonstrate that its drug was “safe for use under the conditions prescribed, recommended, or suggested in the proposed labeling” before it could distribute the drug. §§102(d), 104(b), 76 Stat. 781, 784. In addition, the amendments required the manufacturer to prove thedrug’s effectiveness by introducing “substantial evidencethat the drug will have the effect it purports or is repre-sented to have under the conditions of use prescribed,recommended, or suggested in the proposed labeling.” §102(d), id., at 781.
As it enlarged the FDA’s powers to “protect the public health” and “assure the safety, effectiveness, and reliabil-ity of drugs,” id., at 780, Congress took care to preserve state law. The 1962 amendments added a saving clause,indicating that a provision of state law would only be invalidated upon a “direct and positive conflict” with theFDCA. §202, id., at 793. Consistent with that provision,state common-law suits “continued unabated despite . . . FDA regulation.” Riegel v. Medtronic, Inc., 552 U. S. ___, ___ (2008) (slip op., at 8) (GINSBURG, J., dissenting); see ibid., n. 11 (collecting state cases). And when Congressenacted an express pre-emption provision for medicaldevices in 1976, see §521, 90 Stat. 574 (codified at 21
U. S. C. §360k(a)), it declined to enact such a provision for prescription drugs.
In 2007, after Levine’s injury and lawsuit, Congressagain amended the FDCA. 121 Stat. 823. For the first time, it granted the FDA statutory authority to require amanufacturer to change its drug label based on safety information that becomes available after a drug’s initial approval. §901(a), id., at 924–926. In doing so, however,Congress did not enact a provision in the Senate bill thatwould have required the FDA to preapprove all changes todrug labels. See S. 1082, 110th Cong., 1st Sess., §208, pp. 107–114 (2007) (as passed) (proposing new §506D).Instead, it adopted a rule of construction to make it clearthat manufacturers remain responsible for updating their labels. See 121 Stat. 925–926.

153. The FDA’s premarket approval of a new drug appli-cation includes the approval of the exact text in the pro-posed label. See 21 U. S. C. §355; 21 CFR §314.105(b) (2008). Generally speaking, a manufacturer may only change a drug label after the FDA approves a supplemen-tal application. There is, however, an FDA regulation that permits a manufacturer to make certain changes to its label before receiving the agency’s approval. Among otherthings, this “changes being effected” (CBE) regulation provides that if a manufacturer is changing a label to “add or strengthen a contraindication, warning, precaution, or adverse reaction” or to “add or strengthen an instructionabout dosage and administration that is intended to in-crease the safe use of the drug product,” it may make thelabeling change upon filing its supplemental application with the FDA; it need not wait for FDA approval. §§314.70(c)(6)(iii)(A), (C).

As the FDA ex-plained in its notice of the final rule, “‘newly acquired information’” is not limited to new data, but also encom-passes “new analyses of previously submitted data.” Id., at 49604. The rule accounts for the fact that risk informa-tion accumulates over time and that the same data maytake on a different meaning in light of subsequent devel-opments: “[I]f the sponsor submits adverse event informa-tion to FDA, and then later conducts a new analysis of data showing risks of a different type or of greater severityor frequency than did reports previously submitted toFDA, the sponsor meets the requirement for ‘newly ac-quired information.’” Id., at 49607; see also id., at 49606.

Wyeth suggests that the FDA, rather than the manufacturer, bears primary re-sponsibility for drug labeling. Yet through many amend-ments to the FDCA and to FDA regulations, it has re-mained a central premise of federal drug regulation that the manufacturer bears responsibility for the content of itslabel at all times. It is charged both with crafting anadequate label and with ensuring that its warnings re-main adequate as long as the drug is on the market.

They try to solve that problem with helpful politicians doing by executive fiat at an agency what they could not do in Congress; for example, by placing a corporate immunity clause in the preamble of an FDA rule that says if a drug is FDA approved, you can't sue. Thus, drug companies ask the courts to imply that preemption exists even though it was not expressly legislated.

Next up is from the Center for Justice and Democracy, a consumer rights group dedicated to preserving the civil justice system. They issued a report today: THE BITTEREST PILL -- How Drug Companies Fail To Protect Women and How Lawsuits Save Their Lives. The report, according to the authors, "tells the story of the hyped marketing to women of a disproportionate number of unsafe drugs and devices resulting in countless deaths and injuries." As you may guess, they aren't too keen on immunity being granted to a company that was negligent, and whose negligence injured people. It's part of that whole personal responsibility thing that conservatives usually talk about, except when it comes to big business.


In piecing together the emails from the FOIAs, AAJ uncovered the cozy relationship between federal officials and the industries they regulate. For example, the pharmaceutical industry intensified its efforts to influence the FDA in the months leading up to the physician labeling rule's release on January 24, 2006. Much of the lobbying efforts were aimed at Sheldon Bradshaw, who had succeeded Daniel Troy as FDA chief counsel in April 2005.

AAJ obtained emails that list attendees of a meeting between Bradshaw and the Pharmaceutical Research and Manufacturers of America (PhRMA) revealing the FDA chief counsel met with legal representatives from Pfizer, Wyeth, Eli Lilly, Berlex, Organon, Abbott Laboratories, Takeda, Sanofi-Aventis, Serono, AstraZeneca, Cephalon, Millenium, Eisai, Amgen, Astellas, GlaxoSmithKline, Bristol Myers Squibb, Johnson & Johnson, Novartis, Merck, and 3M.

Less than six months after this meeting, the agency would release its final physician labeling rule with complete immunity preemption language in the preamble, a complete about-face from the language in the proposed rule that specifically said the agency did not intend to preempt state law with the rule.

"Big business lobbyists have been on a crusade to destroy state consumer protection laws, and further stack the deck against American consumers," said Weisbrod.
